WL Hydrotherapy Terms and Conditions
WL Hydrotherapy is committed to providing safe, accessible, and therapeutic hydrotherapy services to the community. These Terms and Conditions are designed to ensure the safety, comfort, and enjoyment of all its users.
Definitions
- “Service Provider” means WL Hydrotherapy Registered Charity Number 1212740
- “Hirer” means the individual or organisation booking the hydrotherapy services.
- “Service User(s)” means the Hirer and their party using or providing the hydrotherapy services; and
- “Premises” means the pool and changing room area.
Legalities
- A contract between the Hirer and the Service Provider will come into existence when a booking is made by email or telephone, and the Hirer thereby agrees to be bound by these Terms and Conditions.
- The Service Provider agrees to hire the Premises to the Service User for their own private use. A lifeguard shall not be in attendance and the Service Provider is not responsible for any actions of the Service User(s).
- The Hirer is responsible for the good conduct of all Service Users during the hire period, and at any time whilst on the Premises, along with the preservation of the equipment provided and surrounding area. The Hirer must also ensure that any children or vulnerable adults are accompanied by at least one responsible adult and are always supervised.
- The Service Provider requires that, at a minimum, there must be one responsible adult in the pool with any children/vulnerable adults and one responsible adult poolside. The number of people present, including children, must not exceed four.
- The Service Provider will ensure water checks are carried out and will carry out visual checks on the Premises and ceiling track hoist between sessions. Should the Hirer and/or a Service User notice any defects, they must notify the Service Provider as soon as possible.
- The Hirer and any Service User shall use the Service Provider’s equipment with care as maintenance, replacements and repairs are expensive. The Service Provider wants to be able to provide the Hirer and future users with this service.
Pool sessions
- The Service Provider requests that the Service User leaves the Premises as they found it and take all their personal belongings with them. WL Hydrotherapy accepts no responsibility for any lost items.
- The Service Provider is committed to providing accessible services to all users. If the Service User requires any specific accommodations, the Service User shall inform the Service Provider at the time of booking.
Bookings and charges
- For healthcare professionals and their clients, the fee per session is £60 per 90 minutes. The Service User is required to provide evidence of its own valid Public Liability Insurance for the Service Provider’s reference by email when booking. Please note that the insurance document will be held on file for no other purpose than to perform its obligations in relation to the use of the facilities within the Premises.
- For private hire, the fee per session is £40 for 90 minutes.
- Bookings are accepted at the sole discretion of the Service Provider and are secured by payment at least 48 hours in advance of the session by bank transfer to the bank account below:

- The charges are reviewed yearly on 2nd January. The service provider will notify service users of any increase by email.
Cancellations / Refunds
- If the Hirer/Service User cancels their booking within 24 hours of the appointment time, no refund will be given. However, the Service Provider will endeavour to move the Service User’s appointment to an alternative available/suitable date if requested.
- Any appointment cancelled with more than 24 hours’ notice can either be refunded or moved to an alternative available/suitable date.
- Any refunds that are made with these conditions are considered on a case-by-case basis and are made as a gesture of goodwill only. These payments will not set a precedent for any future cancellations/refunds.
- Refunds, when applicable, will be processed within 14 days of cancellation.
Your liability
- The Hirer agrees that he/she, and any Service User, shall use the Premises strictly in accordance with the Service Provider’s Pool Rules, a copy of which is provided.
- The Service Provider reserves the right at its absolute discretion to charge for damage to the Service Provider’s equipment due to misuse or accident, caused by negligence or otherwise. The Service Provider accepts no liability for misuse or accidents when the Service Provider’s equipment is damaged on site.
- The Hirer is responsible for any injuries, accidents, or damages that occur during the hire session and the Service Provider is not liable for any such incidents.
- For the avoidance of doubt, the Service Provider does not exclude liability where it would be unlawful to do so, this includes for death or personal injury arising as a result of negligence, fraud of fraudulent misrepresentation or any other circumstance where liability cannot be excluded by law.
- The Hirer agrees to indemnify the Service Provider against any claims or legal actions arising from the Hirer/Service User’s use of the pool, provided that such claims are made within three months of the incident giving rise to the claim.
- The Service Provider’s total liability in contract, tort (including negligence or breach of statutory duty), misrepresentation, restitution or otherwise arising in connection with the performance or contemplated performance of these Terms and Conditions will in all circumstances be limited to the total price paid by the Hirer for the hydrotherapy sessions.
- If the Premises or the pool is soiled by vomit or faeces etc., then a fee of £250 will be charged to the Hirer and there may be additional costs to refund any sessions that were cancelled due to this incident.
- If the Service Provider is prevented from or delayed in performing its obligations as a result of the Hirer/Service User’s act or omission or by any circumstances outside of the Service Provider’s control, it will not be liable for any costs, charges or losses sustained or incurred by the Hirer/Service User that arise directly or indirectly from such prevention or delay.
- There is free parking available on site, next to the pool building. The Hirer and any Service Users park their cars entirely at their own risk.
Complaints
- In the event of there being cause for complaint, the matter should be taken up with theService Provider or its staff as soon as possible. It is important that this is done whilst the Service User is still on site so that an ‘on the spot’ investigation can be made, if necessary, and immediate action can be taken if required.
- In no circumstances will compensation be considered for complaints raised after the session has come to an end, when the Hirer has denied the Service Provider or its staff the opportunity of investigating the complaint and to remedy matters during or immediately after the session.
Applicable Laws and Jurisdiction
- These Terms and Conditions and any dispute or claim arising out of or in connection with it shall be governed by English law, and either party may bring legal proceedings in connection with the law of England and Wales. The courts of England and Wales shall have the exclusive jurisdiction to settle any dispute or claim.
- All intellectual property rights in or arising out of or in connection with the hydrotherapy services (other than intellectual property rights in any materials provided by the Hirer) shall be owned by the Service Provider.
- The Service Provider reserves the right to modify or terminate these Terms and Conditions at any time. Upon termination, any outstanding fees must be paid immediately.
Confidentiality and Data Protection
- Neither party shall use the other party’s confidential information without its consent for any purpose other than to perform its obligations under these Terms and Conditions.
The Service Provider is committed to protecting the Hirer/Service User’s privacy and will only use the information collected lawfully in accordance with the General Data Protection Regulation and in accordance with UK privacy laws.
